Court Declines to Award Shs 500m Compensation, Instead Orders Shs 4.6m to be Paid for 'Sacred Tree’, after Shs 150m was Previously Offered for them by UNRA But They Rejected It Claiming that Amount Will Not Appease Their Ancestral gods.
Court orders UNRA to pay Shs4.6m for 'sacred tree’, instead of Shs500m claimed by owners.
The High Court in Mpigi has on Thursday dismissed a case filed by members of the Lugave Clan of Buganda kingdom, who sought to be paid half a billion shillings for a tree which is located along the site of the Busega-Mpigi Expressway.
The process to acquire this land hit a deadlock as owners put in the exorbitant claim for the tree, which they say is spiritual.
The tree is known as ‘Nabukalu’ and is said to belong to the Lugave clan, although one Hussein Katamba also claimed ownership.
UNRA head of public relations Allan Ssempebwa revealed that the court had ruled in favor of the Authority to dismiss the claim.
The court also ordered for the tree owners to be compensated as per the determination of the Chief Government Valuer (CGV).
“The CGV assessed Shs 4.6Million and its what the court has actually granted” he Ssempebwa said.
The Shs 4.6m he said is for the entire land where the tree is located, which measures about 0.083 decimals.
The Mpigi expressway project is currently at 10% and is hoped to be completed by 2025 according to UNRA’s Director of Roads and Bridges Eng. Samuel Muhoozi.
