Kapeere survived being sent to prison for fighting in public and instead, the court ordered him to do some work in the community. As Kapeere was leaving, he was grabbed by a police officer who handcuffed him again telling him that there was still another case of cyber harassment against him that was reported by his ex girlfriend Nakimuli. Kapeere has protested his arrest and claims that it is not right for the police to arrest him after he has been released by the court even if he might have committed another offense.

There is no limit to the number of offenses a person can be charged with if they are suspected to have taken part in committing them. These can even be different offences or the same kind of offence For example some people have been charged with 20 counts of an theft (This means that person is charged with stealing 20 different items). It is therefore possible for a person to be charged with two criminal cases usually arising out of two separate set of events.
Court can only hear and attend to two offenses at the same time, or more if they came from the same set of events. For example, if you beat a person, killed another one and also stole at the same time in the same place, then these offenses all arose from the same set of events.
In Kapeere’s case, his cases are two different cases that came up from two different and distinguishable events. The court cannot listen to both at ago since they have to different witnesses and the prosecution must also prepare differently for them. Kapeere fought with Fred so that was the first offense known as affray, and he also sent unwanted annoying and threatening messages to Nakimuli (his ex) so that’s another offense known as cyber harassment. These are two different offenses but they were both committed by Kapeere so he has to be charged for them and brought before a court to answer for them.
Therefore what happened to Kapeere was legal.
