We always told there is matrimonial property this, matrimonial property that....
Today we want to talk about what it is. By law, every person is allowed to own property in his/ her personal capacity or as a part of a group.
Marriage does not change the rights that a person may have over property. If you owned property before you got married, then this property remains your property.
In Uganda, there is no specific law that defines what matrimonial property is, however, the courts have said that matrimonial property is that property that a married couple chooses to call home, and any other property that a married couple or either of them contributes to, directly or indirectly, and may be registered in their joint names.
It does not matter whether such property is registered in the names of either the husband or the wife, the law may still take it to be matrimonial property. If however you choose to treat this property as your home with your spouse, then this means that it becomes matrimonial property.
