Mabirizi gave away two goats and a sack of millet to the barmaid, who served him delicious beef and malwa (local brew). Her family just came this morning and picked up the gifts from his home. Mabirizi has denied ever giving those things away 'mbu' he was not in his right mind. However everyone (including mabirizi) knows he can drink two full crates of beer before getting drunk. Can he legally deny giving away the goats and millet to the barmaid?
You can't always blame it on the alcohol!! Just because you have taken a few beers does not mean you can blame all your bad decisions on this. Today we want to talk about something called Capacity.
Capacity means your ability to understand the nature and consequences of your actions and to make decisions (based on this understanding). It is whether or not a person is legally able to do or not something. For example, to enter a contract or agreement or give away something.
Drinking a few beers does not necessarily take away your ability to understand what your actions mean. If you still have this ability, it means that you will be held accountable for it.
