Sebawali and his brother Kembo produced a movie 10 years ago and it was aired on YouTube. They have been receiving money from it since then. Kemba unfortunately was told that he had a deadly disease, and he does not have long to live. He has been wondering whether his children will continue to benefit from his movie once he is no more.
WHAT DOES THE LAW SAY?
Copyrights protection lasts for the life of the author of the work and 50 years after they pass on. After fifty years, this work belongs to the public and no one can claim ownership.
Copyrights are treated as any other form of property, where they are two authors of a piece of work with equal rights, they will both benefit equally. In case one of them passes away, the rights are protected until the death of the co-surviving author and 50 years after.
Therefore Sebawali and Kembos children will be in a position to benefit from their work when they pass on as copyrights are treated just like any other property only that there is an expiration date.
