Kizito finally went on a date 6 months after he broke up with Samali. Then he bumped into Samali who was working at the restaurant. Somehow, they started arguing and Samali decided to give some ‘advice’ to Kizito’s date. She told Kizito’s date to stop dating ‘short men’ like Kizito just because they have some money especially when they are as ‘bad looking as him because they are serial cheaters. Kizito’s date got scared and left him immediately.
Kizito wants to know if he can sue his Ex for abusing him in public like this especially infront of his new catch.
WHAT DOES THE LAW SAY?
In law, you are free to say what you think about something. This is called having an opinion. You need to be sure what you say is true, or factual. If your statements are untrue and they are intended to damage another person’s reputation. Then you have committed an offence known as defamation.
For someone to be answerable for defamation, there must be 3 things.
1. The statement must be untrue, or misleading.
2. It must be made to someone other than the person who is complaining.
3. It must be capable of damaging that person’s reputation or changing how people will look at them.
Although a defamatory statement can be either written or spoken or both, in Uganda, it is only a criminal offence if the statement is written. For you to win a case about ‘spoken’ statement you must show that there was a special damage. For example, if Kizito was using his looks and height for making money such as being a model, then it would be damaging for his ex-girlfriend to call him short, ugly and it would also need to be untrue. So, what happened to Kizito does not amount to defamation.
