In criminal law, there are three main ways that a person can be held responsible for committing a criminal offence.
The first way is by actively doing something that the law considers to be illegal. The second way is by doing something to help someone commit a crime, such as leaving the window or backdoor to the bank open so it can be used. The third way is by helping the person to plan and encouraging them to go through with it, such as fixing weaknesses in their robbery plan. Any of these will attract the same offence as the person who committed the crime.
However, after the crime has been committed, if you know that someone has committed a crime and you help that person not to get caught, you will be called an “accessory after the fact” to the crime, which means they are considered to be a part of it.
However, when we come to husbands and wives (the legally married ones), the law is a bit different. If a husband commits a crime, his wife can’t be punished just for helping him hide from the police or escape punishment. Likewise, if a wife commits a crime, her husband can’t be punished just for helping her hide from the police or escape punishment.
So, even if Nakato saw her husband committing a crime, she is not under an obligation to report this even if it means that it helps him to avoid getting caught.
