Bulemye has always been told that she looks like Bianca. So, she spent time and looked for her pictures and posted all of them as her own on Instagram, Facebook, and all her social media platforms. She even started telling people that those were her photos, but since she resembles Bianca, Bianca uses them. Bianca found out, and she is angry and does not want her picture on a stranger’s profile. Is it legal for Bulemye to do this?

WHAT DOES THE LAW SAY?

The laws of Uganda (Data Protection and Privacy Act) say that no one has a right to your personal information (like your pictures) without your permission. This means that even if you use your photos on social media, no one can take use them for whatever purpose they want.

Therefore, if someone posts a picture of you without your permission, they are violating your right to privacy and therefore  committing a crime.

Posting your pictures on Twitter, Instagram or other social media sites, does not take away your rights. However, your use of this social media site is subject to “Terms and Conditions”. So, remember to read these “Terms and Conditions” to ensure you do not allow them to use your photo whenever they want.

In case a random stranger reposts a photo of you on their pages, you can ask the social media site to remove it or block access to that person. If the person has used it to make money, they can be asked to compensate you.
