Dear lawyers, what happens if my grandfather left all his property to his children, but then my uncle passed away before my grandfather. Now that my grandfather is dead, the children of my uncle want his share of the property that he left behind for his children. Are they entitled to anything?
This depends on how your grandfather distributed the property, if he said that the property belongs to his children, the share of the property of the ones who have passed away is supposed to be shared by those who survived. However, if he was specific about the exact share that his children were to benefit, then they cannot just take what would have belonged to someone else even if that person passed away. This property goes back to the estate of your grandfather and if he is still alive, he must decide what to do with it or it will be shared by everyone including the grandchildren (as dependants).
