Do you remember when we were young, and you wanted to prove that you were telling the truth? You would say I swear!!!! And lick your finger and even swear on ‘your mother’s grave’: Well in law, we do not do ‘pinky swears’, or even swearing on parent’s graves or their death. Instead, we swear in written form so that what we swear to can be relied on in law (such as in court).
HOW DO YOU DO THIS?
This swearing takes the form of either a statutory declaration or affidavit. This is where you state a fact in writing and the law holds you to the truthfulness of everything that you have said.
Once you have stated that fact, then someone who is known as a commissioner of oath must witness what you are doing by signing and putting his/her stamp/ seal to that document.
This person has been authorized to witness and witness that you have taken this oath, affirmation and to sign on all declarations.
WHO CAN BE A COMMISSIONER OF OATH?
1. Any advocate who has practised law for at least two years can apply for this authorization.
2. All magistrates, judges and registrars of the court are commissioners of oath because of the titles they hold.
It is an offence to tell people that you are a commissioner of oath or do their work if you have not been authorized to do this work by the chief justice (head of all judges in Uganda).
WHEN CAN YOU USE THIS?
1. Change of names
If you wish to change your name, you must state your old name and tell the world that you are the same person using ‘new names’.
2. Verifying names
You can also use this document to show that although there are two documents with a different order of names, they all refer to you.
3. Giving testimony in court cases
The courts will also not rely on your written statement and take it as your version of the truth unless it has been witnessed and stamped by this commissioner of oath.
