FAMILY INTERFERENCE AND MARRIAGE.
On Sunday, Nakimuli and Fred visited his parents and told them about Nakku (Nakimuli and Kapeere’s daughter). This news shocked Rosette (Fred's sister), who called Nakimuli a ‘mufeere’ (liar and fraudster) because (a) she was not a virgin, and (b) she has a child from another relationship and even asked Fred to cancel and get out of the marriage This alarmed Nakimuli who wondered whether such as a thing could be used to end her marriage to Fred.
Can my marriage be cancelled if I lied about something?
The law says that there should be consent (knowingly allow something) when two people are entering a marriage. That consent meaning agreeing to marry someone knowing all the facts that may help you make your mind up about either doing it or not.
If a person can proof that their consent to the marriage was because of either force or fraud (trickery or deception), the court ‘cancel’ the marriage. This is called annulment of the marriage. (Treating the marriage like it never existed). This tends to extend to things that are fundamental to the marriage relationship, such as your religion, your marital status etc.
For example, if Fred had told Nakimuli that he did not want to marry someone with children, then knowing about Nakku (her child with Kapeere) and Nakimuli had lied about having no children, then it would be that Nakimuli deceived Fred into marrying her without knowing the truth
If you deceived your partner into thinking you were one thing and not the other, then your spouse can ask court for this cancellation. As things stand between Nakimuli and Fred, Nakimuli did not lie to Fred about Nakku (her daughter) so there is no need for Fred to ask for the annulment.
Can In-laws end Nakimuli’s marriage
No, they cannot.
In law, marriage is between two consenting adults. This means that it is only these two who can choose to marry or to leave the marriage. Anyone else whose consent was not needed for the marriage does not have a say in whether the court cancels this marriage.
