CAN YOUR BOSS FORCEFULLY DEDUCT YOUR SALARY FOR ANYTHING? .

Zaweze has been working at the same place for the last 5 years. Last month, his boss has introduced office lunch for all staff. Zaweze was attracted by the buffet on offer and has since not missed a single meal. ON the 25th of the month, he was surprised to find that his usual 600,000 salary was less by 200,000. He asked his boss who told him that this was contribution for the lunch that was introduced for all staff. Zaweze is confused because he really thought that office food was free for employees. He needs to know if what his boss is doing is right or not.

WHAT DOES THE LAW SAY: The law (the Employment Act 2006) strictly prohibits deductions to employee salaries, except in certain circumstances such as NSSF, Trade Union fees, Taxes unless the employee specifically gave his/her permission. This can be for deductions such as bank loans, SACCO savings.

Zaweze can start by asking his boss to refund his deducted salary and to allow him to choose whether he wants to pay for the lunch or not. If this fails, then Zaweze can report this matter to the District Labour Office for further guidance.
