Yesterday, we asked you about Jackson who went to play soccer against the local village team. He did not appreciate the tackles he recieved and as a result decided to take out his anger on a fellow player. To cut the looong story short, Jackson had to be restrained as he was chocking the other player to death and the police has since then been looking for him for attempted murder. We asked you for your thoughts on whether there was any crime. Thank you for your comments. Now let us share our own thoughts as well.
As you may very well know, all sports events carry some level of risk. (Including chess by the way) For example if you participate in a boxing match, you are taken to have acknowledged that there is a risk that you could have a swollen eye, broken jaw etc. similarly in football, it is expected that there will be some kicks flying around and tackles. This may even result in broken bones among others. If you accept to take part in any of these sports with these known risks, the law says that you have voluntarily accepted and taken on those risks. (This is called voluntary assumption of risk).
However, it is not expected that you will be castrated by another plater or that a player will strangle you or slam you with a chair until your back or head is broken. If a player or person involved in the game does this, they will have stepped outside the rules and expected risks of the game and the law can now go after them for their criminal conduct. Therefore, in our case, Jackson can be reported to police for aggravated assault or even attempted murder because what he did, is not conducted that is expected to result from a football match. This is not even restricted to a player against another player, but against anyone who may be present. You cannot for instance kick a fan, or kick a referee in the head even if you are in disagreement with his decision.
