Musa was riding his boda boda going home. While on the road, Kafeero’s goat came running into the road from nowhere and Musa hit it. The goat fell and died. Musa’s boda boda also got damaged and needs to be repaired. Musa is demanding that Kafeero repair his motorcycle for him, but Kafeero is also demanding that Musa should buy him another goat or give him 200,000 UGX for the goat. Who should be compensated in this case?

WHAT DOES THE LAW SAY?

According to the law, if a person brings to his land and it escapes, that person is answerable for all the damage of the escape. This means that if anything on your land escapes and goes out and causes damage, then you are responsible for that damage. Additionally, according to the Uganda Traffic and road safety Act, if you are in charge of any animal and you allow it to become a danger or annoyance to the public, you commit an offence and you could be liable to pay a penalty on conviction.

This therefore means that as an owner of an animal, it is your responsibility to make sure that you take care of your animals and that they do not escape to cause damage to another person’s land. Ifhowever you let your animals escape and go to a road and that animal creates danger or annoyance, then you are liable for the damage caused by that animal. In the above case therefore, Kafeero has to pay Musa for the damage that was caused on his motorcycle.
