The East African Court of Justice has Dismissed Lawyer Mabirizi Kiwanuka's Petition Seeking to Stop Yoweri Kaguta Museveni from Contesting in 2021 Presidential Elections Over Age Limit.
The East African Court of Justice has dismissed lawyer Male H Mabirizi Kiwanuka’s petition seeking to bar President Museveni from participating in 2021 elections on account of old age.
The petition Reference No. 6 of 2019 Male H Mabirizi Kiwanuka vs. The Attorney General of Uganda sought to stop President Museveni from appearing on the 2021 ballot on account of age.
Museveni who turned 75 would be ineligible to run in 2021 presidential election if he had not scrapped age limit from the constitution.
The Reference challenged the decision of the Supreme Court of Uganda that upheld the enactment of Constitutional (Amendment) Act No. 2 of 2018.
Court held that the process leading up to the enactment of the Constitutional Amendment was time barred, but found the impugned Supreme Court decision to have been filed within time.
Court further found that the impugned decision was not res judicata and that it had jurisdiction to interrogate the matter.
Court found no Treaty violation by the Supreme Court on account of judicial ethics or in terms of its judicial process and result.
Finally, the Reference was dismissed with costs to the Respondent.
